Copyright Policy

Orbinly respects intellectual property. This page explains how to report content that infringes your copyright and what happens next.

1. Reporting infringement

Orbinly stores files and other content that customers and their clients upload. If you believe content on the Service infringes a copyright you own or are authorised to act for, send a written notice to our copyright contact (section 5) that includes:

  • your physical or electronic signature;
  • a description of the copyrighted work you say has been infringed;
  • a description of where the material is on the Service, with enough detail (such as a link) for us to find it;
  • your name, postal address, telephone number and email address;
  • a statement that you believe in good faith that the use is not authorised by the copyright owner, its agent or the law; and
  • a statement, made under penalty of perjury, that the notice is accurate and that you are the owner or authorised to act for the owner.

A notice that does not include these details may not be actionable. Knowingly misrepresenting that content is infringing can make you liable for damages under 17 U.S.C. § 512(f).

2. What we do

When we receive a valid notice we act quickly to remove or disable access to the material, tell the customer who uploaded it, and may share your notice (including your contact details) with them.

3. Counter-notices

If your content was removed and you believe that was a mistake, or that you have the right to use it, you may send us a counter-notice with: your physical or electronic signature; a description of the material and where it appeared before it was removed; a statement under penalty of perjury that you believe in good faith it was removed because of a mistake or misidentification; and your name, address and phone number, a statement that you consent to the jurisdiction of the federal court for the district where you live (or, if outside the United States, the Middle District of Florida), and that you will accept service of process from the person who sent the original notice. If we receive a valid counter-notice we will send it to the person who complained and may restore the material in 10 to 14 business days unless they tell us they have started a court action.

4. Repeat infringers

In appropriate circumstances we close the accounts of customers who are repeat infringers. We may also close an account after a single serious infringement.
