Terms of Service
Please read these terms carefully before using Orbinly. By accessing or using our service, you agree to be bound by these terms.
1. Acceptance of terms
By creating an account or using Orbinly ("Service", "we", "us"), you agree to these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, do not use the Service.
2. Description of service
Orbinly provides a white-label platform for agencies and freelancers to create branded client portals including project management, file sharing, invoicing, and messaging features.
3. Accounts and registration
You must provide accurate, complete information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.
4. Billing and payments
Paid plans are billed in advance on a monthly basis. All fees are non-refundable except as stated in our refund policy. We reserve the right to change pricing with 30 days' notice. Failure to pay may result in suspension of your account.
5. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose
- Upload malicious code or interfere with the Service
- Attempt to gain unauthorised access to any system or data
- Resell or sublicense the Service without written permission
- Impersonate Orbinly or any third party
6. Intellectual property
You retain all rights to your content. By uploading content, you grant us a limited licence to store and display it solely to operate the Service. We retain all rights in the Orbinly platform, software, and branding.
7. Data and privacy
Your use of the Service is subject to our Privacy Policy, which is incorporated into these Terms by reference.
8. Termination
Either party may terminate at any time. We may suspend or terminate your account immediately for violations of these Terms. On termination, your data is retained for 30 days before permanent deletion, giving you time to export.
9. Limitation of liability
To the fullest extent permitted by law, Orbinly shall not be liable for any indirect, incidental, consequential, or punitive damages. Our total liability in any month shall not exceed the fees paid by you in that month.
10. Changes to terms
We may update these Terms from time to time. We will notify you by email and via an in-app notice at least 14 days before material changes take effect. Continued use of the Service after changes constitutes acceptance.
